How many hours should it be? Does it need to be indefinite, or can multiple part-time contracts be submitted?

ARRAIGO LABORAL THROUGH SOCIAL ROOTS:

Arraigo Laboral is a highly processed and sought-after residency authorization, especially for those who have never held documentation or have lost it due to the inability to renew their permits. We receive many questions about this permit frequently and thought it best to add a blog post with full details.

For this type of permit, meeting requirements for the last three years’ stay in Spain, having no criminal record, possessing an Integration Report, and additionally providing a job offer, a business plan, or demonstrating personal or family financial means are necessary.

To obtain Arraigo Laborla, there are three options related to the labor aspect:

  • Having a job offer
  • Starting our own business
  • Having personal resources

WORK CONTRACT AND SOCIAL ROOTS:

In this regard, the regulations offer various options for the type of work contract to be submitted for Social Roots, explained in detail below.

  • Job Offer for 30 hours

The first option is to have a work contract signed by both the worker and the employer, ensuring at least the minimum wage or the established salary in the applicable collective agreement at the time of the application. The total hours must represent a weekly workload of no less than thirty hours, guaranteeing at least the Spanish minimum wage.

qhe contract may have a minimum duration of 20 hours in cases where the worker has dependents or individuals requiring support for the exercise of their legal capacity.

This is the most commonly used option to access Social Roots.

JOB OFFER IN THE AGRICULTURAL SECTOR:

The second option, as per Royal Decree 57/2011, for accessing Arraigo Laboral, is to provide multiple full-time contracts in the agricultural sector.

In this case, it is possible to submit several contracts in the agricultural sector, each lasting 6 months.

This means submitting an initial 6-month contract and, once it ends, having another job offer for another 6 months. Thus, completing a year of work, as in the previous option, but with two different work contracts and two different employers.

q) Why is it allowed to submit two consecutive contracts?
a) In these cases, it is only possible if both contracts are in the agricultural sector.

We all know how challenging it is to secure a year-long job offer, especially in agriculture. In this sense, having two employers and two job offers makes it easier.

The agricultural sector operates in campaigns, and it would be simpler to obtain an offer for olive harvesting and tree pruning first, followed by another job offer for asparagus or garlic harvesting, for example. Both campaigns occur in very different months, and it is challenging for a single employer to cover the entire year with different campaigns.

PART-TIME CONTRACTS:

The third option for the Arraigo Laboral contract is to have multiple part-time work contracts.

Here, one can engage in activities of the same or different occupations, working part-time and simultaneously for more than one employer. The submission of multiple part-time contracts ensuring the minimum wage is accepted.
