THE KEYS TO THE NEW SOCIAL-LABOUR ROOTS RESIDENCE IN SPAIN:
After nearly a year of anticipation and delays caused by the catastrophic floods in Valencia, the Council of Ministers has officially approved the long-awaited reform of the Spanish Immigration Regulations on November 19, 2024.
The Social-Labour Roots part of this update will undoubtedly be the main method used to regulaize illegal foreigners in our country when the new immigration regulations come into force in May 2025.
Within these new legal immigration reforms, we see one of the most important residence updates as the Social-Labour Roots Residence which will be an active Spanish Immigration Law within six months.
The current social roots residence law requires a minimum time in Spain of 3 years prior to application, no previous criminal penalties and a report which demonstrates the applicants social integration report, while the new Social-Labour Roots residence is different and does not require a social integration report.
This is a residence permit for applicants who have roots in the country of Spain and who can demonstrate them.
The changes which have been made, provide advantages in that the period of stay in our country required to make the application has been reduced to only two years. Another important advantage is that it will be enough to provide a contract of work with a minimum of only 20 hours of work. These agreed in 20 hours demonstrated in the work contract will undoubtedly make it much easier for many foreigners who are already in Spain in an irregular situation, and who are already working, to regulate their situation.
This also makes it easier for employers to make this type of work contract which not only allows their forgien workers to enter into a legal situation, but also permits them to enter the labor market with a work-contract which could be a part-time contract and not a permanent contract which legally obligates their employer.
Regarding Social insertion reports, these can take up to seven or eight months to obtain, so, not requiring them to make the application will also make it much easier for many foreigners to be able to apply once this regulation comes into force in May 2025. From our point of view, it is thought that this change in the law will make it a lot easier to legalize people who are not-legal in Spain.
Taking into account that this new regulation also counts time spent in Spain as, for example, an asylum seeker, to be included in their required two years to make the application, many people will no longer want to apply for asylum, and remain in Spain ilegally, to make their application after being in Spain irregularly for two years. Many do not like this, and think that much more forceful measures should have been established to facilitate hiring in origin and are critical of this regulation in that sense.
