TEMPORARY RESIDENCE PERMIT:
A temporary residence permit, commonly known as a “residencia temporal” in Spain, grants individuals the right to reside in the country for a limited duration. This type of permit is typically issued to non-EU citizens who wish to live in Spain for a specific purpose, such as work, study, or family reunification.
One of the primary characteristics of a temporary residence permit is that it carries a validity period, which is usually renewable upon expiration. Depending on the circumstances, temporary residence permits can be granted for durations ranging from a few months to several years. Renewal requirements may vary based on factors such as employment status, financial stability, and compliance with Spanish immigration laws.
Temporary residents are entitled to access certain rights and benefits in Spain, including healthcare, education, and employment opportunities. However, they may be subject to restrictions on residency duration, employment sectors, and travel outside of Spain.
Holders of a temporary residence permit are required to spend a minimum of 183 days per year in the country to allow renewal of the permit.
PERMANENT RESIDENCE PERMIT:
A permanent residence permit, known as “residencia permanente,” offers long-term residency rights to individuals who have established strong ties to Spain. Unlike temporary permits, permanent residency is not time-limited and provides greater stability and security to residents.
To qualify for a permanent residence permit, individuals typically need to meet specific criteria, such as continuous legal residence in Spain for a certain period, sufficient financial resources, and integration into Spanish society. EU citizens and their family members may also apply for permanent residency after living in Spain for five consecutive years.
Permanent residents enjoy almost the same rights and benefits as Spanish citizens, including access to public services, healthcare, and education. They also have greater flexibility in terms of employment and travel with no requirement to spend more than 183 days in the country for renewal.
HOW TO OBTAIN PERMANENT RESIDENCE IN SPAIN:
To obtain permanent residence in Spain the following must be demonstrated:
- Not be a citizen of a European Union (EU) Member State, the European Economic Area (EEA), or Switzerland, or a family member of citizens of these countries to whom the EU citizen regime applies.
- Have no criminal record in Spain or in previous countries of residence for offenses under Spanish law.
- Have legally and continuously resided in Spain for five years.
The continuity will not be affected by absences from Spanish territory of a maximum of six continuous months, provided that the total does not exceed ten months within the five years. If for work reasons, it cannot exceed one year in total, within the required five years.
