COME TO WORK IN SPAIN:

For those who want to come to Spain to work, it helps to understand that Spain faces challenges to fill specific job positions.

Due to this, there is a part of the 2024 residency reform which focuses on the recently expanded catalogue of roles which are Difficult To Cover, especially in the Construction sector.

The 2024 residency reform aims to address two issues: stabalize the economy and enable companies to hire personnel from outside of Spain, which could lead to more flexible recruitment from abroad in general.

SPANISH NATIONALS’ FAMILY MEMBERS:

Since the 2022 immigration update which identified relatives of Spanish nationals, and allowed direct relatives to be included in the Family Arraigo Residence Authorization, moving from a Community Card to being able to obtain a Family Arraigo Residence Authorization.

While this reform in 2022 was positive, it is now deemed as insufficient and does not include updated for certain relatives, like children over 21 or ascendants under 65, who still needed to demonstrate financial dependence. just likw to the old requirements for a Community Card.

A SINGLE RESIDENCY PERMIT FOR ALL:

The 2024 immigration regulation reform aims to simplify existing permits. The move is towards a single permit, consolidating various scenarios or situations under one authorization.

Currently, there are numerous cards and authorizations, and the goal is to reduce the number of cards or permits available in Spain.

These changes are expected to be implemented in the first six months of 2024. We’ll keep you updated on any developments.

SPANISH IMMIGRATION REGULATION REFORM 2024:

The objective is to streamline procedures, enhance migrant rights protection, reduce the number of existing permit categories, simplify documentation and procedures, and reinforce the protection of migrants’ rights.

It will also transpose two European directives approved during the Spanish presidency: the “Single Permit Directive,” streamlining the process for a combined work and residence permit, and enhancing protection against labor exploitation, and the “Long-Term Residence Directive” improving the rights of long-term residents and their families.

The Minister of Inclusion, who presided over the Immigration Sector Conference, thanked the collaboration of Autonomous Communities, municipalities, other ministries, and social entities in addressing the challenges posed by migrant arrivals and asylum seekers.

CHANGES IN SPANISH IMMIGRATION 2024:

Similar to previous years, the plan is to modify the Immigration Regulations through a Royal Decree to incorporate these changes. The goal, as in 2022, is to simplify and reduce the numerous permits available today.

Both Spanish law and the immigration regulation cover a wide range of permits, authorizations, renewals, modifications, permit compatibilities, each with numerous requirements and documentation. This often leads to confusion for citizens navigating through the process.

Cards and permits that closely resemble each other, authorizations covering very similar situations, cause inconvenience and inefficient resource allocation. Recent examples include two permits for “Highly Qualified Professionals” regulated in both the Immigration Regulation and the Entrepreneurship Law. This was corrected in the 2022 reform by repealing the articles in the regulation governing this permit.

In addition to legal changes, there’s a need for a shift in perspective within immigration offices. Despite the goal of favoring legal residence, some offices still apply a restrictive interpretation of immigration law, rooted in past decades. Changes in both legislation and its application, recognizing the diversity of our society, are essential.

In conclusion, the main idea behind the Immigration Regulation Reform is to defend the rights of foreigners and simplify residence authorization procedures in Spain.
