SOCIAL INTEGRATION: RESIDENCE PROCEDURES THROUGH SOCIAL INTEGRATION IN SPAIN:

Social Integration is a permit through which many people can regularize their administrative status in Spain. This Residence Authorization for Exceptional Circumstances can be processed whether you have never had a residence permit before or if you had one but lost it due to inability to renew.

REGULATORY FRAMEWORK FOR SOCIAL INTEGRATION:

Residence through social integration in spain in 2024 is a residence and/or work permit in Spain is regulated by the following Laws or regulations:

  • Organic Law 4/2000, of January 11, on the Rights and Liberties of Foreigners in Spain and Their Social Integration (art. 31.3), known as the Immigration Law.
  • Regulation of Organic Law 4/2000, approved by Royal Decree 557/2011, of April 20 (articles from 62 to 66 and from 123 to 130), i.e., the Immigration Regulation.
  • Royal Decree-Law 19/2012, of May 25, on urgent measures of liberalization of trade and certain.
  • Law 39/2015, of October 1, on the Common Administrative Procedure of Public Administrations.

WHAT TYPE OF PERMIT IS OBTAINED WITH SOCIAL INTEGRATION?:

As mentioned, Social Integration is a temporary residence permit for exceptional circumstances that can be granted to foreign citizens in Spain who either have family ties in Spain or are socially integrated with  residence through social integration in spain in 2024.

This permit can be for residence only, or for residence and work, either as an employee or self-employed.

This authorization is valid for one year, and as it approaches expiration, it can be renewed to continue staying in Spain completely legally.

REQUIREMENTS FOR SOCIAL INTEGRATION:

The requirements to obtain this type of residence and/or work permit are:

  • Not be a citizen of a European Union member state, the European Economic Area, or Switzerland, or a family member of citizens from these countries subject to the Union citizen regime.
  • Have no criminal record in Spain and in previous countries of residence for offenses specified in Spanish law.
  • Not be prohibited from entering Spain and not be listed as rejectable in the territorial space of countries with which Spain has signed an agreement to that effect.
  • Not be within the commitment period not to return to Spain that the foreigner assumed when voluntarily returning to their country of origin.
  • Have stayed continuously in Spain for a minimum period of three years. To meet this requirement, absences from Spain during this period cannot exceed 120 days.
  • Have family ties (spouse or registered partner, ascendants or descendants in the first degree and direct line) with other foreign residents or Spaniards, or present a report proving their social integration issued by the Autonomous Community (or the City Council if authorized by the Autonomous Community) where they have their habitual residence.
  • Have a work contract signed by the worker and employer, guaranteeing at least the minimum interprofessional salary or the established salary, if applicable, in the applicable collective agreement, at the time of the application, and whose sum must represent a weekly working hours of no less than thirty hours overall and guarantee at least the minimum interprofessional salary.

The contract may have a duration of a minimum of 20 hours in cases where there is evidence of having dependents or individuals who require support for the exercise of their legal capacity. More than one employment contract can be submitted in the following cases:

  • In the case of the agricultural sector, the submission of two or more contracts with different employers, concatenated, each of them.
  • In the case of carrying out activities in the same or different occupation, working partially and simultaneously for more than one employer, the submission of several contracts will be allowed.
  • The company or employer must be registered with Social Security, as well as being up to date with its tax and Social Security obligations.
  • The company must also guarantee continuous activity, have economic, material, or personnel resources to address its business project and the obligations arising from the contract. If it is an individual, it must demonstrate, once the agreed salary is deducted, 100% of the Public Income Indicator (IPREM) if there are no dependents (600 euros per month in this year 2024).
  • In the case of a family unit with two members, 200% (1200 euros in this year 2024). If the family unit includes more than two people, the previous amount must be added to the 50% of the IPREM for each additional member (1200+300 euros).
  • In the agricultural sector, two contracts with different employers and concatenated can be submitted, each with a minimum duration of six months.
  • Multiple contracts can also be submitted in the same occupation, working simultaneously for more than one employer, all with a minimum duration of one year and whose sum must represent a weekly working hours of no less than 30 hours overall.

SOCIAL INTEGRATION WITHOUT A CONTRACT, IS IT POSSIBLE:

As you can see, to process this type of authorization in Spain, it is necessary to have a job offer for a duration of one year on a full-time basis.

But if you don’t have a job offer or the ability to demonstrate an employer willing to give you this employment contract, can’t you apply for Social Integration?.

If you don’t have a job offer or any employer willing to give you this employment contract, you can apply for Social Integration without a work contract, this residency can be obtained as a Self-Employed resident.

SOCIAL INTEGRATION FOR SELF-EMPLOYMENT:

Social Integration can also be achieved by creating your own company and working as a self-employed person in Spain.

For this, you will need to prove:

  • A Business Plan. Within this business plan, you must specify who your clients will be, what activity you will carry out, how much you estimate to generate, what your expenses will be, etc.
  • You must also prove that you have the economic means necessary to make the investment and start your business. The regulations do not establish a minimum amount to invest, but this amount will depend on the type of business you want to start.
  • In addition to this investment, you must prove that you have economic resources to live in Spain. In this case, it is required to have 100% of the monthly IPREM (which amounts to 600 euros per month).

These three requirements are, let’s say, the three fundamental pillars of Social Integration for self-employment, but you must also prove:

  • Meet the requirements that current legislation requires for the opening and operation of the projected activity.
  • Have the required professional qualification or proven experience in the exercise of the professional activity, as well as, where appropriate, membership when required.
  • Social Integration with Own Resources

The other option you have to apply for Social Integration in Spain without a work contract is to prove that you have your own finances to sustain yourself.
