RESIDENCY IN SPAIN THROUGH LABOUR TIES AS ARRAIGO LABORAL

REQUIREMENTS FOR RESIDENCY THROUGH ARRAIGO LABORAL:

The minimum requirements for processing this Residence Permit for Exceptional Circumstances are:

  • Not being a citizen of a European Union, European Economic Area, or Swiss state, or a family member of citizens to whom the Union citizen regime applies
  • No criminal record in Spain and in previous countries of residence for offenses under Spanish law
  • Not being prohibited from entering Spain and not being listed as rejectable in the territorial space of countries with which Spain has a signed agreement to that effect
  • Not being, if applicable, within the commitment period not to return to Spain that the foreigner assumed when voluntarily returning to their country of origin
  • Having stayed continuously in Spain for a minimum period of two years. Continuous stay is understood if absences have not exceeded 90 days in the last two years
  • Being able to demonstrate the existence of employment relationships lasting at least six months

TWO YEARS OF STAY IN SPAIN:

Similar to Social Residency (Arraigo Social), Residency through Arraigo Laboral can be processed when you have stayed in Spain for at least two years continuously.

This stay must also be immediately preceding the application for this permit. Therefore, if you are considering applying for this type of authorization in Spain, you need to provide documentary evidence that you have lived here and have not been outside for more than 90 days during that period.

To prove that you have stayed in Spain, you can submit any document with your full name and date, such as historical registration, invoices, money transfers or medical certificates.

PROVING 6 MONTHS OF EMPLOYMENT:

Within that two-year period, it is necessary to have worked for at least 6 months.

It is also essential that the employment relationship has had some importance. In other words, you must prove:

  • That you have worked as an employee with a contract or contracts involving work of 30 hours per week or 15 hours per week over a period of 12 months.
  • Or that you have worked as a self-employed person for 6 months continuously.

CHANGES IN THE FOREIGNER’S REGULATION:

Currently, it is necessary to prove that you have worked for at least 6 months within the 2-year period. The employment relationship(s) must have occurred within a legal stay or residence.

With the entry into force on August 16, 2022, of the reform of the Foreigner’s Regulation, many people can benefit from Residency through Labor Ties and obtain a residence and work permit.

This group of people may include:

  • Individuals who had the Red Card, worked, and were ultimately denied asylum
  • People who had a residence and work permit, worked, and could not renew it
  • Foreigners holding a Residence Permit as a Highly Qualified Professional who cannot renew their permits
  • Individuals with a Community Card who are no longer entitled to it today
  • Also, those who have worked as self-employed, etc.

OBTAINING RESIDENCY THROUGH LABOR TIES:

RENEWING RESIDENCY THROUGH LABOR TIES:

Like any permit in Spain, once it is nearing expiration, it is necessary to renew it to avoid staying irregularly in Spain.

In this sense, we must meet certain requirements, especially of a labor nature, to modify this permit to a Residence and Work Authorization for Salaried or Self-employed Work.
