FAMILY MEMBERS:
Family members of Golden Visa holders will maintain their residence status, provided the primary visa was obtained before April 3, 2025.
- Any new family member applications submitted after April 3, 2025, will be inadmissible under the provisions of Law 14/2013.
- This includes new family situations arising after this date (e.g., marriages, births), as these cases will now fall under the general immigration regime.
INHERITANCES & TRANSMISSIONS:
The right of residence is non-transferable, as it is a highly personal authorization.

Consequently, transfers occurring after April 3, 2025—whether through inheritance, donation, or any other inter vivos transaction—cannot be used to justify or maintain the investment-based residence permit.
CHANGES OF NATIONALITY:
The initial residence authorization remains valid despite a change of nationality. An extension is permitted, provided the change was formally and promptly notified to the relevant authorities.
EARNEST MONEY CONTRACTS:
Earnest money contracts (e.g., preliminary deposits) are not admissible for securing a Golden Visa.

They do not constitute a final sales contract and, by their nature, include the possibility of withdrawal or renunciation.
INVESTMENT CONVERSIONS:
A residence permit will be retained and, if applicable, renewed upon an investment conversion, only under the following conditions:
- Conversion is between non-real estate investment types.
- Conversion is from a real estate investment to any other qualifying investment type (provided all minimum amounts are met).
Note: Conversions from other investment types to real estate investment are not permitted.
REWNEWALS:
Renewals are permitted in all cases where the initial authorization was rightfully granted and met all legal requirements at the time of issuance.
CHANGES TO LEGAL ENTITY:
Changes in the ownership of capital or investments within a legal entity are not permitted, as a legal entity itself cannot hold a personal residence permit.
Transfers of investment from a legal entity to a natural person are also not permitted, as this constitutes a prohibited inter vivos transfer.
UNEMPLOYMENT:
Residence status is maintained for individuals receiving unemployment benefits, for the duration of the benefit entitlement. This is conditional upon meeting the requirements set forth in the RLOEx, which applies supplementarily in this scenario.
PART-TIME WORKERS:
Part-time workers must, in all cases, demonstrate an annual salary that meets or exceeds 100% of the minimum salary threshold required for Highly Qualified Personnel.
