In 2022, Royal Decree 629/2022, was published in the Official State Gazette, amending the Regulations of Organic Law 4/2000, explaining many new updates for expats who reside in Spain.
In this publication we will discuss updates for students and the ability for them to work.
➢ STUDENTS
The authorization to stay for studies will allow you to work as an employee or self-employed as long as it is compatible with the completion of the studies, responding to a demand raised by students and university institutions.
What kind of studies will allow compatibility?
- Higher studies
- Regulated training for employment or aimed at obtaining a professional certificate
- Training leading to obtaining the certification of technical aptitude or professional qualification necessary for the exercise of a specific occupation
What requirements must the work activity have?
The work activity may not have a working day greater than 30 hours per week.
Does the work authorization have any limitations?
The authorization to work will not have geographical limitations, unless the lucrative activity coincides with the periods in which the studies, research, non-work practices, or volunteer service are carried out.
However, this geographical limitation will not apply in the following cases:
➢ When it is proven that the form of organization of the work activity will allow its compatibility with the achievement of not requiring continuous displacement

➢ When the location of the work centre or the centre in which the self-employment activity is carried out does not imply continuous displacement that entails breaking the requirement of compatibility with the main purpose for which the stay was granted
How long is the work authorization valid?
The validity of the authorization to work will coincide with the duration of the stay authorization.
Can the work authorization be extended?
Authorizations to work will be extended if the circumstances that motivated the previous concession persist, as long as the extension of the stay authorization has been obtained.
