1) FAMILY ARRAIGO RESIDENCY IN SPAIN:

Family Arraigo for family ties is a long-standing residence permit, gaining significant applications since August 2022.

The most recent modification of this Immigration Regulation permits the inclussion of direct relatives through Family Ties.
The following relatives of Spaniards can obtain this residency:

  • Spouse
  • Registered Partner
  • Children under 21 or older if financially dependent
  • Ascendants over 65 or financially dependent adults

This is a temporary residence authorization granted in the following cases:

  • When it is the father or mother, or guardian of a minor of Spanish nationality, or it is a person who provides support to a Spanish person with a disability.
    In the case of the spouse or accredited de facto partner of a citizen of Spanish nationality, an ascendant over 65 years of age or dependent under 65 years of age, a dependent descendant under 21 years of age or over 21 years of age, of a citizen of Spanish nationality Spanish, or your spouse or de facto partner.
  • Children of a father or mother who had originally been Spanish.

If your relatives are outside Spain, they must enter as relatives of a Spanish citizen, either without a short-stay visa for Spain or by obtaining the corresponding visa from the Consulate if needed.

2) FAMILY REUNIFICATION IN SPAIN:

Family Reunification, often confused with Family Arraigo for family ties or the Community Card, serves the same purpose but applies in different scenarios.

Family Reunification is processed when a legal resident in Spain reunites with family members residing outside the country. Eligible relatives for reunification include:

  • Spouse or someone in a similar affective relationship
  • Children, including adopted ones, under 18 or disabled
  • Legally represented minors or those disabled and unable to provide for their needs

This residency application is more complex than Family Arraigo application and the Community Card, requiring meeting specific and intricate requirements.

3) – COMMUNITY CARD RESIDENCE IN SPAIN:

Direct relatives of Spaniards or those falling under the extended family can also apply for a Community Card.

Regulated by the Community Royal Decree, this Residency Card for Family Members of a Community Citizen is currently available.
Relatives of Spaniards or EU citizens eligible for this card include:

  • Spouse, provided there is no annulment, divorce, or legal separation
  • Registered partner in a union akin to marriage
  • Direct descendants and those of the spouse or registered partner under 21 or financially dependent adults
  • Direct ascendants and those of the spouse or registered partner financially dependent

Family members, regardless of nationality, not covered in the decree can accompany or reunite with the EU citizen if they prove circumstances such as financial dependency or the need for personal care.
