HOW TO OBTAIN NATIONALITY THROUGH MARRIAGE

HOW TO OBTAIN NATIONALITY THROUGH MARRIAGE?

Like all countries, Spain has a procedure for foreigners who marry their nationals to acquire nationality.

A very common question among our clients is, how can I obtain nationality through marriage in Spain?

To avoid any doubts or confusion, we explain how to obtain nationality through marridge:

There is no specific procedure for acquiring Spanish nationality through marriage in Spain, because the legal system provides a way to acquire Spanish nationality through residency. This is the same path that foreigners married to Spaniards should use to obtain their nationality.

Put simply, to apply for Spanish nationality through residency, an essential requirement is to meet certain periods of legal residency in Spain.

As a general rule, the period will be ten years of legal residency, continuous and immediately prior to the submission of the application.

Although, this period can be reduced to five years if the foreigner has been recognized as a refugee.

In the case of nationals from Ibero-American countries, Andorra, the Philippines, Equatorial Guinea, or Portugal, or Sephardic individuals, they can request Spanish nationality when they complete two years of legal and continuous residency in Spain.

And finally, if you are in any of the situations mentioned in Article 22 of Civil Code, one year of residency will be sufficient to submit your application (it is required to understand the situation of the applicant).
