FAMILY MEMBERS YOU CAN REUNITE AS RESIDENTS AFTER OBTAINING NATIONALITY

In this article we discuss which family members you can reunite to be residents of Spain after you obtain Spanish nationality.

Living in Spain will have brought you both benefits and significant sacrifices, including being far from the customs of your home country and friends and family.

Undoubtedly, leaving your closest family members behind can be one of the most challenging aspects. If however you have been granted Spanish nationality, do you know that “extended family” and which family members you can reunite them as residents of Spain?

REUNITE YOUR SPOUSE:

The spouse or de facto not separated spouse of a Spanish citizen or any other European Union citizen residing in Spanish territory can reunite legally, provided the marriage was not fraudulent and allow them residency in Spain as a first family member.

REUNITE REGISTERED COMMON-LAW PARTNER:

A non-EU citizen who is a partner of a Spanish citizen or any other European Union citizen residing in Spanish territory. Registered in a Public Registry of Common-law Partners, either regional or local, without allowing duplication of registration.

REUNITE CHILDREN UNDER 21:

Children of the Spanish citizen or non-EU citizen spouse or registered common-law partner of a Spanish or EU citizen.
Provided they have authorization from the other parent where applicable. This comes without the need to demonstrate financial dependence.

REUNITE CHILDREN 21 OR OLDER LIVING AS A FINANCIAL DEPENDANT:

Children of a non-EU citizen spouse or registered common-law partner of a Spanish or EU citizen residing in Spanish territory.
Once they reach 21 or older, it’s mandatory to prove they are financially dependent in their country of origin.

REUNITE PARENTS OVER 65 OR FINANCIALLY DEPENDENT PARENTS:

Such as mother, father, mother-in-law, father-in-law of the Spanish citizen or the spouse or registered common-law partner of a Spanish citizen residing in Spanish territory.
If the parents of the Spanish citizen are under 65, it must be proven that they are financially dependent in their country of origin or residence.

REUNITE EXTENDED FAMILY:

Any family member who was dependent or living with the Spanish or EU citizen residing in Spanish territory at the time of application.
Relatives for whom it is strictly necessary for the EU citizen to personally take care of them due to severe health issues or disabilities.

REUNITE UNREGISTERED COMMON-LAW PARTNER:

A stable relationship is considered if it proves the existence of a lasting bond.
In this case, the existence of this bond is proven when there is at least one year of prior marital-like cohabitation or if there are children in common. Stable cohabitation is sufficient to prove it.
Once you’ve brought any of these family members to Spain and they are with you in the country, you can process the Family Reunification. This procedure should be initiated at the Foreigners’ Office of your residence, and once the card is granted, it will be valid for five years.
