The Digital-Nomad visa is now fully operational and here we analyze this permit which allows remote work in Spain and opens the possibility of developing professional activity outside of Spanish territory.

WHO CAN APPLY FOR THIS VISA:

This can be requested by all non-EU citizens who want to carry out a remote work or professional activity and who can prove:

  • Having a graduate or postgraduate degree
  • Having a vocational training qualification from a prestigious school
  • Or that they have more than 3 years of experience in the sector

Here, the law makes a clear distinction between the employee and the self-employed.

  • Employee: In this case, the worker can only work for companies based outside of Spain.
  • Self-employed: If you have your own business or are self-employed, you can work remotely in Spain for companies based outside of Spain and for companies located in Spain but with a limitation. The percentage of work offered to companies based in Spain cannot exceed 20% of the total professional activity.

REQUIREMENTS FOR A VISA AS A DIGITAL NOMAD:

  • Not being in an irregular situation in Spanish territory.
  • Be over 18 years old.
  • Have no criminal record in Spain and in the countries where they have resided for the last two years, for crimes provided for in Spanish law. Additionally, a responsible declaration of the absence of criminal records for the last five years will be presented.
  • Not be considered inadmissible in the territorial space of countries with which Spain has signed an agreement to that effect.
  • Have private health insurance contracted with an insurance company authorized to operate in Spain.
  • Have sufficient economic resources for themselves and their family members during their period of residence in Spain.  
  • The existence of a real and continuous activity for at least one year of the company or group of companies with which the worker maintains a labor or professional relationship. 
  • Documentary evidence that the labor or professional relationship can be carried out remotely.
  • In the case of an employment relationship, the existence of the same between the worker and the company not located in Spain for at least the last three months prior to the submission of the application must be accredited, as well as documentation that accredits that said company allows the worker to carry out the work activity remotely.  
  • In the case of the existence of a professional relationship, it must be accredited that the worker has a commercial relationship with one or more companies not located in Spain for at least the last three months, as well as documentation that accredits the terms and conditions in which they are going to carry out the professional activity remotely.
