WHAT IS CITIZENSHIP THROUGH BEING SPANISH OF ORIGIN:

This is a provision which serves as a reparative measure for individuals who endured exile. It outlines a rule for acquiring Spanish nationality for those born outside Spain to parents or grandparents exiled for political, ideological, or belief reasons.

This provision also extends to children born abroad to Spanish women who lost their nationality by marrying foreigners before the enactment of the 1978 Constitution. Additionally, it includes adult children of Spaniards whose original nationality was acknowledged through the right of option outlined in this law.

WHO CAN OBTAIN SPANISH CITIZENSHIP THIS WAY:

Those who are Spanish of Origin:

  • Those born to a Spanish Father or Mother.
  • Those born in Spain when they are children of foreign parents if at least one of the parents was born in Spain (children of Diplomats are excepted).
  • Those born in Spain to foreign parents, if both lack Nationality (Stateless Persons), or if the Legislation of neither of them attributes a Nationality to the child. In this case, a File can be made to declare Spanish Nationality with the value of simple presumption.
  • Children born in Spain whose parents’ identity is unknown. Minors whose first known place of stay is Spanish territory are presumed to be born in Spain.​​​
  • Minors under 18 years of age who are adopted by a Spaniard are also Spaniards of Origin. If the Adoptee is over 18 years of age, he or she may opt for the Spanish Nationality of origin within a period of two years from the constitution of the Adoption.

THE RULES ON BEING SPANISH OF ORIGIN:

Individuals born outside Spain to ancestors, whether a father, mother, grandfather, or grandmother, who were originally Spanish and lost or renounced Spanish nationality due to exile for political, ideological, belief, sexual orientation, or identity reasons, may choose to obtain Spanish nationality under Article 20 of the Civil Code.

Additionally, those falling under the following categories may also acquire Spanish nationality:

  1. Offspring born abroad to Spanish women who forfeited their nationality by marrying foreigners prior to the enactment of the 1978 Constitution.
  2. Adult children of Spaniards whose original nationality was acknowledged through the right of option as stipulated by this law or under the seventh additional provision of Law 52/2007, dated December 26.

It is mandatory to formalize this declaration within two years from the enactment of this law.
